Why Carpenter Mediation?

Attorney Kevin Carpenter has represented BOTH defendants and plaintiffs, in trials and appeals, and in settlement negotiations. On the plaintiff’s side, Kevin knows what it takes to put together a successful claim, and knows the emotional issues that claimants usually have. On the defendant’s side, he knows how people with authority to settle typically evaluate claims—what’s significant to them and what isn’t. Kevin Carpenter knows the negotiation “games” played by both sides; and knows several different ways to break through a deadlock in negotiations.

Kevin Carpenter really IS a neutral mediator.

Maybe because of birth order (he was born third in a family of four children), Kevin tends to see both sides of a dispute without sensing that one side is “right” and the other is “wrong” or that one side is “good” and the other is “bad.” They’re just different. The lyrics in an old song by Dave Mason accurately describe Kevin’s approach to mediation: “There ain’t no good guy; there ain’t no bad guy; there’s only you and me and we just disagree.”

Kevin Carpenter is pretty dispassionate except about settlement.

Kevin wouldn’t say that “I’ve seen it all” but since he was first sworn in as a lawyer in 1979, he’s seen a lot. He can, and does, empathize with a person’s loss or tragedy. But Kevin also has a very strong feeling that he can best help BOTH sides of a dispute by helping them get it resolved. For him, the best part of being a mediator is being a peacemaker.

Kevin Carpenter is old enough to have experience and young enough to have energy.

Most people want a mediator that has seen a lot of different disputes and seen how they’ve been resolved. Kevin certainly has that experience. But in most cases, the parties also need a mediator that can do a lot more than carry settlement proposals between them; the parties need a mediator that’s willing to work hard to get the case settled. That’s Kevin Carpenter.
